Terms of service

These terms are an agreement between wiredfor, based in Guadalajara, Jalisco, Mexico ("we"), and the organization that creates a Kirky workspace or signs an order ("you"). The person accepting them confirms they can bind that organization.

The Data Processing Agreement, the Acceptable Use Policy and any signed order form are part of this agreement. If they conflict, the signed order form wins, then the Data Processing Agreement, then these terms.

Kirky is an AI assistant you embed in your own web application. It has five layers (Help, Knowledge, Queries, Actions and Centinela), and your plan decides which ones you can turn on.

You are responsible for the people you give access to the portal, for keeping sign-in details safe, and for the signing keys your backend uses to identify your users. Tell us right away at security@kirkyapp.com if you suspect unauthorized access.

Each workspace has a Live environment and a free Test environment. Test has its own limits and is for integration, not for production use.

Plans are billed in advance, monthly or yearly, in US dollars. Customers in Mexico are billed in Mexican pesos and receive an electronic invoice (CFDI). Prices exclude taxes.

A query is an answered question or an executed action, as the pricing page describes. We let your admin know at 80% and at 100% of the plan’s queries. At 110% the assistant pauses until the next period, unless your admin turned on automatic top-ups with a spending cap.

Fees already paid are not refundable except where the law requires it or these terms say otherwise.

Everything you and your users put into Kirky, and what Kirky produces from it, is yours. You give us permission to process it only to provide, secure and support the service for you, as the Data Processing Agreement describes. We don’t use it to train models.

You are responsible for having the right to load the documents and connect the systems you give Kirky, and for telling your users that they use an AI assistant.

Kirky answers from your sources and shows them, and says it doesn’t know when your sources don’t cover a question. Even so, AI can make mistakes. Answers are aids to your team’s judgement, not professional advice, and your team stays responsible for the decisions it makes with them.

Actions only run after the person confirms a preview, with that person’s own permissions. Kirky can’t delete records. Centinela warnings are suggestions; they never block.

You agree to use Kirky according to the Acceptable Use Policy and to make sure your users do too.

Each of us will keep the other’s confidential information private, use it only for this agreement and protect it at least as carefully as our own.

We work to keep Kirky available and publish its current state on the status page. Planned maintenance is announced in advance when it may interrupt the service.

We improve the product continuously. If we change these terms or remove a feature you pay for in a way that materially affects you, we will tell you in advance.

You can cancel at any time; the service continues until the end of the paid period. We may suspend access that puts the service or other customers at risk, or that breaks the Acceptable Use Policy, and will tell you why.

When the agreement ends, you can export your data during a transition window. After it, we delete it as the Data Processing Agreement describes.

We provide the service with reasonable skill and care. Beyond what these terms say, the service is provided as it is, and we don’t promise it will be free of errors or interruptions.

Neither of us is liable for indirect or consequential losses, such as lost profits or lost data that could have been avoided with reasonable backups. Our total liability under this agreement is limited to the fees you paid in the twelve months before the claim, except where the law doesn’t allow a limit.

This agreement is governed by the laws of Mexico. Any dispute goes to the courts of Guadalajara, Jalisco, unless a signed order form says otherwise.
